I want to change my daughter's last name to mine ...

I want to change my daughter's last name to mine since her father isnt in her life. I notice on the birth certificate that he put a middle name that he made up it wasnt given to him by his parents. Does it mean that i dont have to ask him to change her last name?

I would check with someone first. Myself I would thunk since thats not his name on the certificate he can't stop you from changing her name .

To change a minor's name legally you need consent from both the biological parents and you need to file your state's appropriate name change form with your county's clerk office. If you file the name change form without the biological parent's consent then the court will determine what's in the best interest of the child. In your case, with the biological father not on the birth certificate, you may get your daughter's name change certified by a judge on these grounds.
