My boyfriend has an ex who is trying to sign over her rights to him, can he take the child without a woman to take over mothering that child

Of course...if she is willing to give up the rights to him than its as simple as filling out a paper and let the judge sign off on it. A judge wants the child put in the best care possible and if a mother dosen't want to help she does not have to. As long as one of the parents wants the child a judge will be happy to sign that paper.
