I purchased a home in 2001 and have since re-married. How do I change the title to my new name and include my husband's name?

And how are you feeling today?

I am pretty sure there are some forms that need to be filled out and filed with the county courthouse but I cannot be sure. Try contacting a real estate attorney to go about filing this paperwork.

You must ask the advice of the company who holds your mortgage... each lender has specific guidelines that must be followed to add or remove a person to or from a mortgage or deed. You should have a contact phone number in your payment booklet or in the statement that you receive monthly.  Call that number, explain your situation and let them guide you through the process.

There is no mortgage, the house was paid in full at time of purchase.

Lucky You! Talk to your attorney about recording a corrected deed! Since there is no mortgage involved, it will be a simple process!!  Good Luck!!!!!

Your Old x husband will need to be removed from the deed. If he agrees without any objections all you will have to do is go to you local Title Company. They can draft the docs. Deeding the property in full in you name all he has to do is show it was deeded for a small amount..ie $10.   Then once you are done you can have them add your new husband.

 

Since the property is PAID IN FULL and it was purchased prior to this husband. I would reccommend you DO NOT place him on the title. If you do he has 50% of you equity.

Keep him on the straight and narrow. This way if things go South of the border you will still have all rites on the property as long as these mariage laws are applical in you state.

 You local title Company Can help or go to a RealEstate attorned to Draft the Deed of trust.
