My suggestion is to contact your loan officer and negotiate a deal where you pay just interest on your mortgage until you can get back on your feet, making sure the arrangement doesn't allow late fees and past due reports to the credit bureaus.   Good luck!    crider

Let Our Team of Mortgage Experts Examine Your Loan for Truth in Lending Act Violations, RESPA Violations and Fraud - Available in All States

http://www.discoveriesinmedicine.com/images/mdis_0000_0003_0_img0101.jpgLoan Modification Service is Now Available in All States by Attorney Gregory A. Paiva & Associates

This service is a very specialized and imperative in identifying if a borrower is a victim of predatory lending. We review all loan documents and perform a thorough investigation for miscalculations and to determine if the loan terms are accurate, truthful, and met the requirements of the applicable federal statutes.

Our #1 goal is to determine whether there were violations of federal law. If these violations are found, then the borrower may be eligible for complete relief of the predatory loan. This is known as a loan rescission. Meaning the lender takes back the "predatory loan" and awards or credits back to the borrower all interest made on payments thus far, loan origination fees, all applicable lenders fees, penalties and attorney's fees.

NOW available in all states!

This can be done by means of a loan modification or a new affordable loan. This allows the borrower to get a new loan with a smaller principle, meaning that the mortgage can be affordable and non-predatory.

FORENSIC LOAN DOCUMENT AUDIT

ü  Complete client interview and all applicable parties

ü  Complete loan document and disclosure audit by 30 year underwriting and fraud and compliance mortgage professional

ü  Truth in Lending Act (TILA) and Real Estate Settlement & Procedures Act (RESPA)

ü  Reverse engineering of your loan terms and Annual Percentage Rate (APR) for possible TILA violations

ü  Complete 10 page report with all violations and findings

CONSTRUCTIVE FRAUD

Material facts include the terms of the loan, whether there is a prepayment penalty, or any other information which a reasonable borrower would want to know before accepting the loan. Did the broker or loan officer or anyone working for the broker or loan officer fail to disclose any material facts to the borrower?

FRAUD AND NEGLIGENT MISREPRESENTATION

Were any representations, statements, or comments, written or oral made by the loan officer, broker, notary or anyone else who contradicted the terms of the documents?

NEGLIGENT MISREPRESENTATION

When a mortgage professional makes errors which a reasonably diligent mortgage professional would not have made, he or she may have made a negligent misrepresentation.

BREACH OF CONTRACT

The note and its attachments are a contract. The broker must follow all the terms of the contract such as the way the interest is calculated, and the penalties it assesses. Were there any terms in the contract which the lender failed to follow?

LOAN AUDIT REPORT

ü  Results report of all factual findings of the forensic audit

ü  Any and all applicable federal law violations

ü  The real terms of your loan

ü  Outline of hidden fees and/or commission earned by your broker or lender

ü  A complete assessment so you can pursue possible legal claims against your broker and/or lender

FORENSIC LOAN DOCUMENT REVIEW FEE SCHEDULE

Ø  $895 for one loan

Ø  $295 for a second mortgage

(This service is available to attorneys and law enforcement and there are discounts for volume.)

Loan Modification & Homeowner Loss Mitigation Service - Available in ALL States

Don't have time to deal with your lender or are you going nowhere fast?

http://a.abcnews.com/images/Health/pd_stress_070508_ms.jpgThis is what we like to call the fix your loan and save your home service for homeowners. Let's face reality, most lenders are completely unresponsive to many of the homeowners who reach out to them for help with their mortgage. In fact hundreds of thousands of homeowners have lost their homes and many more will as a result of miscommunication, servicing abuse and just plain neglect.

A loan modification is when the lender modifies your current mortgage in order to work with you and make your mortgage more affordable. In the past this was only used when a borrower was delinquent but now it is being used before someone is delinquent to give them relief from a future mortgage adjustment.

As many borrowers know from their own experience is that the resistance from their lender or mortgage servicer is high and just getting through to the appropriate person is very difficult. However, when a lawyer is involved it seems as if the calls start to get answered and the letterers responded to. Often everything you say, can and will be used against you. With an attorney involved, you have an important ally in your corner.

We use powerful laws like the Truth in Lending Act (TILA) and the Real Estate and Settlement Procedures Act (RESPA) to bring lenders to their knees. These laws MUST be followed and failure to do so can result in significant damages to the lender. So, naturally, they will be very amicable to working your loan out to more affordable terms to avoid costly litigation.

Many times the borrower is charged a lot of unexplainable fees and charges the lender cannot back up. The Law Offices of Gregory A. Paiva & Associates, demand that these fees be fully documented to the penny and we insure that our clients are not being over charged by their lender or servicer.

We do not tolerate abuse and command respect with our thorough knowledge of the law. We are consumer and homeowner advocates that will protect you and your home.

We do not approach a loan modification just like every other bogus loss mitigation company that is advertising to save homeowners from foreclosure. Many of these companies are not even attorneys and they are offering to represent a client and highly sensitive manner. Many operate from their kitchen tables and many homeowners have been scammed by these unscrupulous people.

The Law Offices of Gregory A. Paiva & Associates have a strict code of ethics and professional responsibility to adhere to and this is a very serious matter that needs serious action by a licensed and competent attorney.

We use the law to place lenders and servicers on the defense and make them fix your loan.

The faster we start the loan modification process and the more time we have to work, the greater the likelihood of success. If you are unsure of the foreclosure laws in your State contact a local real estate professional, or our office.

Loan Modification Fees:

  • The cost for a loan modification is $2,495 for a first mortgage.
  • To add a second mortgage for $400 more for a total of $2,895

* Bonus - Homeowners will receive a free forensic loan audit reviews as part of the loan modification package. This is a $895 value. If it is found that you are the victim of predatory lending or mortgage fraud, then you will have the option to retain the The Law Offices of Gregory A. Paiva & Associates or we can use these Federal law violations to demand that your lender modifies your mortgage.

Call Dan North at (406) 546-2517 or email dnloansolutions@aol.com for your free consultation now.
