President Obama might have stretched the truth on at least one matter during his address Wednesday on healthcare reform, but, contrary to a Congressman's now-infamous outburst, Obama was correct on illegal immigration, according to the nonpartisan FactCheck.org.


GOP Congressman Joe Wilson of South Carolina has paid a steep political price for shouting "you lie!" during the portion of President Obama's healthcare address in which Obama said the reform efforts would not include illegal immigrants.


But was Wilson accurate?


FactCheck.org says no. Actually, FactCheck's analysis on this point came in response to a mass email making 30 claims about the House healthcare bill. The site concludes that 26 of those claims were false. Among them: "All non-US citizens, illegal or not, will be provided with free healthcare services."


FactCheck's response:


"That's simply not what the bill says at all."


While the bill does state that reform will be provided "without regard to personal characteristics," it also explicitly states: "Nothing in this subtitle shall allow Federal payments for affordability credits on behalf of individuals who are not lawfully present in the United States."

H.R. 3200 health care reforms will benefit illegal aliens

"The reforms I'm proposing would not apply to those who are here illegally," President Obama said in a carefully worded statement to a Joint Session of Congress and the American public last night. The problem, notes the Federation for American Immigration Reform (FAIR), is that the health care reforms proposed in H.R. 3200, America's Affordable Health Care Act of 2009, clearly would benefit illegal aliens.


"Perhaps the reforms that President Obama advocates would not cover illegal aliens, but those are not the reforms currently under consideration by Congress," commented Dan Stein, president of FAIR. "H.R. 3200, the legislation that the House will be voting on, would allow illegal aliens to benefit from the government-financed public option, and includes no verification provisions to prevent illegal aliens from receiving taxpayer subsidies to purchase private health insurance."
President Obama's assertion that illegal alien would not be covered under AAHCA is directly contradicted by an August 25 report, Treatment of Noncitizens in H.R. 3200, issued by the Congressional Research Service. The nonpartisan research arm of Congress concluded, "H.R. 3200 does not contain any restrictions on noncitizens - whether legally or illegal present, or in the United States temporarily or permanently - participating in the [Health Insurance] Exchange."
Once in the Exchange, participants are free to enroll in the government run health insurance program. This public option, established under H.R. 3200, would be heavily or entirely subsidized by the American taxpayers. While illegal aliens are barred from receiving "affordability credits" to help pay for private insurance, CRS noted the absence of any mechanism in the bill to verify citizenship or legal residency.
"There is no reason why the controversy over whether illegal aliens will be eligible for massive health care subsidies should persist," said Stein. "The president, congressional leaders, and the public all agree they should not. The authors of H.R. 3200 can easily remove the ambiguities from the House bill, and Senate leaders can include specific language barring illegal aliens from all nonemergency benefits in the bill that is being written in that chamber.
"President Obama himself can also play an important role in seeing to it that his wishes are carried out by publicly urging leaders of both houses to include clear, unambiguous language in their legislation that would preclude illegal aliens from coverage under his health care reform proposal," Stein continued. "FAIR stands ready to work with the White House and congressional leaders to develop legislative language that would make sure that President Obama's pledge to the American people is fulfilled."

Tippy, Why are the dems pushing health care for illegals then. Read today news. The goal of the health care is for coverage of the illegals. This is for a power base that will not be reversible. In next few years they will be a majority.  That is the Dems ultimate goal. Wake up and smell the coffee.  I agree with the Judge. You are misinformed.

What Really Happened Last Week in Montana.This was sent to me by a friend in Bozeman , MT who was there. Why do we tolerate this? Hello All, By now you have probably heard that President Obama came to Montana last Friday. However, there are many things that the major news has not covered. I feel that since Bill and I live here and we were at the airport on Friday I should share some facts with you. Whatever you decide to do with the information is up to you. If you chose to share this email with others I do ask that you DELETE my email address before you forward this on. On Wednesday, August 5th it was announced locally that the President would be coming here. There are many groups here that are against his healthcare and huge spending so those groups began talking and deciding on what they were going to do. The White House would not release ANY details other than the date. On about Tuesday Bill found out that they would be holding the "Town Hall" at the airport. (This is only because Bill knows EVERYONE at the airport) Our airport is actually located outside of Belgrade (tiny town) in a very remote location. Nothing is around there. They chose to use a hangar that is the most remotely located hangar. You could not pick a more remote location, and you can not get to it easily. It is totally secluded from the public. FYI: We have many areas in Belgrade and Bozeman which could have held a large amount of folks with sufficient parking. (gymnasiums/auditoriums). All of which have chairs and tables, and would not have to be SHIPPED IN!! $$$$$ During the week, cargo by the TONS was being shipped in constantly. Airport employees could not believe how it just kept coming. Though it was our President coming several expressed how excessive it was, especially during a recession. $$$$$ Late Tuesday/early Wednesday the 12th, they said that tickets would be handed out on Thursday 9am at two locations and the president would be arriving around 12:30 Friday. Thursday morning about 600 tickets were passed out. However, 1500 were printed at a Local printing shop per White House request. Hmmmm......900 tickets just DISAPPEARED. This same morning someone called into the radio from the local UPS branch and said that THOUSANDS of Dollars of Lobster were shipped in for Obama. Montana has some of the best beef in the nation!!! And it would have been really wonderful to help out the local economy. Anyone heard of the Recession?? Just think...with all of the traveling the White House is doing. $$$$$ One can only imagine what else we are paying for. On Friday Bill and I got out to the airport about 10:45am. The groups that wanted to protest Obama's spending and healthcare had gotten a permit to protest and that area was roped off. But that was not to be. A large bus carrying SEIU (Service Employees International Union) members drove up onto the area (illegal)and unloaded right there. It was quite a commotion and there were specifically 2 SEIU men trying to make trouble and start a fight. Police did get involved and arrested the one man but they said they did not have the manpower to remove the SEIU crowd. The SEIU crowd was very organized and young. About 99% were under the age of 30 and they were not locals! They had bullhorns and PROFESSIONALLY made signs. Some even wore preprinted T-shirts. Oh, and Planned Parenthood folks were with them.....professing abortion rights with their T-shirts and preprinted signs. (BTW, all these folks did have a permit to protest in ANOTHER area) Those against healthcare/spending moved away from the SEIU crowd to avoid confrontation. They were orderly and respectful. Even though SEIU kept coming over and walking through, continuing to be very intimidating and aggressive at the direction of the one SEIU man. So we had Montana folks from ALL OVER the state with their homemade signs and their DOGS with homemade signs. We had cowboys, nurses, doctors you name it. There was even a guy from Texas who had been driving through. He found out about the occasion, went to the store, made a sign, and came to protest. If you are wondering about the press.....Well, all of the major networks were over by that remote hangar I mentioned. They were conveniently parked on the other side of the buildings FAR away. None of these crowds were even visible to them. I have my doubts that they knew anything about the crowds. We did have some local news media around us from this state and Idaho . Speaking of the local media...they were invited. However, all questions were to be turned into the White House in advance of the event. Wouldn't want anyone to have to think off the top of their head. It was very obvious that it was meant to be totally controlled by the White House. Everything was orchestrated down to the last detail to make it appear that Montana is just crazy for Obama and government healthcare. Even those people that talked about their insurance woes........the White House called our local HRDC (Human Resource and Development Committee) and asked for names. Then the White House asked those folks to come. Smoke and mirrors...EVERYTHING was staged!!!!!!!!!!! I am very dismayed about what I learned about our current White House. The amount of control and manipulation was unbelievable. I felt I was not living in the United States of America , more like the USSR !! I was physically nauseous. Bill and I have been around when Presidents or Heads of State visit. It has NEVER been like this. I am truly very frightened for our country. America needs your prayers and your voices. If you care about our country please get involved. Know the issues. And let Congress hear your voices again and again!! If they are willing to put forth so much effort to BULLY a small town one can only imagine what is going on in Washington DC . Scary!! Have a good day. Live free or die.

We suspect it's rare that the president gets heckled during a speech to a joint session of Congress, but Rep. Joe Wilson didn't hold back.

"You lie!" shouted the South Carolina Republican. This was in response to President Barack Obama's statements on illegal immigrants.

"There are also those who claim that our reform effort will insure illegal immigrants," Obama said. "This, too, is false — the reforms I’m proposing would not apply to those who are here illegally."

So who's right here? Wilson or Obama?

Incidentally, Wilson apologized for the outburst after the speech, but said he still disagreed with Obama's statement. (DYK writes:  But Wilson apologized only because the Republican leadership forced him to apologize.)

We've been monitoring claims about health care reform and illegal immigrants for some time now. Most notably, a chain e-mail claimed that page 50 of the House bill gave free health care to illegal immigrants. That page didn't say that. Rather, it included a generic nondiscrimination clause that said insurers may not discriminate with regard to "personal characteristics extraneous to the provision of high quality health care or related services." So we rated the chain e-mail's claim Pants on Fire .

We read all 1,000-plus pages of the health care bill and were struck by the fact that it is largely silent on health care for illegal immigrants. Keep in mind that experts estimated there were 6.8 million uninsured illegal immigrants in the United States in 2007, out of a total of 11.9 million illegal immigrants. Right now, there are laws on the books that require hospitals to treat severely ill people who arrive at the hospital, regardless of immigration status, and we didn't see anything that would change those laws, either.

Most illegal immigrants are also now excluded from Medicaid, the government-run health care for the poor. We didn't see anything that would change that.

One place where the bill does mention immigration status is for "affordability credits." These are tax credits for people of modest means need to buy health insurance. The credits would help them buy insurance on a national health insurance exchange. The bill specifically says that people in the United States illegally are not eligible for tax credits, on page 132, section 242.

Still, given all that, we have heard from people who said that other aspects of reform could benefit illegal immigrants.

One of the most detailed responses was from the anti-immigration group Federation for American Immigration Reform, called FAIR. You can read their statement on the matter on their Web site.

Primarily, they argue that illegal immigrants would be permitted to purchase insurance on the national health insurance exchange because the bill does not include a mechanism for verifying citizenship. So illegal immigrants would have the chance to purchase insurance in the public option, a government-run health care plan that would offer basic coverage at a low price.

FAIR also argues for more robust verification measures for the affordability credit and making sure that illegal immigrant parents won't be able to receive coverage if their citizen children are eligible.

FAIR has a point that illegal immigrants would likely be able to buy insurance on the national health insurance exchange. We don't see anything in the bills that would hinder that. A Congressional Research Service report issued Aug. 25, 2009, confirmed our observation. The House bill "does not contain any restrictions on noncitzens participating in the Exchange — whether the noncitizens are legally or illegally present, or in the United States temporarily or permanently," the report said.

But it's worth pointing out that illegal immigrants participating in the exchange would be paying for their insurance like everyone else. That's similar to the current system — we're not aware of any particular restrictions that stop illegal immigrants from buying private insurance now. Under health care reform, illegal immigrants would be able to buy private insurance or the public option.

When we look at all of this evidence, it seems that health reform leaves in place the status quo on illegal immigration, and certainly does not provide any new benefits particularly for illegal immigrants. We hope to look at this issue more in the days ahead, because some hospitals are concerned about recouping their costs for treating illegal immigrants, and we're curious to know more about that problem and how it might or might not be solved by reform.

The best argument that we find that health reform would help illegal immigrants is that some might be able to purchase the public option — if it passes, and it might not — on the new health insurance exchange. They would purchase that at full cost. Obama said, "The reforms I’m proposing would not apply to those who are here illegally," which Wilson said was a "lie." Actually, Obama can make a pretty thorough case that reform doesn't apply to those here illegally. We don't find the public option argument enough to make the case that Obama "lied."
