Is this legal?

I was divorced almost a year ago. I couldn't afford a good attorney so I had to settle for what was granted to me by the court.  My ex and I owned a business together which he was granted in the divorce.  He lied about almost everything including the values of our belongings.  His sister has a friend who is a judge (our residence area was not her jurisdiction) and she began calling my attorney and the judge who presided over our divorce.  Is this legal?  Is it too late to do anything about it?

  If the judge has given his final decree, you can't do anything about it.

  Don't waste yopur money on this.  You'll pay more money to the lawyer than what you will get.  Move on and just be thankful this man is out ur life.

You should have a consultation with an experienced Family Law attorney (not your attorney of record). If you do not know any attorneys, contact your state's Bar Association for a referral to an attorney in your area. (There is usually a nominal fee for this service.)

When you meet with the attorney, be sure to take with you a copy of your final Judgment as well as copies of all other documents pertaining to the divorce.

Additionally, make a list of all your questions and bring that with you to the apointment. If the attorney feels you have cause to ask the Court to set aside the Judgment, s/he will let you know.

(You would then have to prepare and file legal paperwork in order to reopen the action. You could retain an attorney to represent you, prepare the papers yourself or hire a legal document preparing service.)

Should the action be allowed back in Court, it is possible that the sitting Judge would make Orders which would change the original decree.

You have nothing to lose by looking into the matter, and possibly everything to gain.

Dear Diana -- it's been a year, and now you want to know if this is legal -- ??  Hey, you likely got railroaded, but waiting a year, whatever the reason, is not a good thing -- and you would have to have absolute proof that there was "influence" or interference regarding the Judge's Order, not just your knowledge -- (which without proof can be called "speculation")  I had a similar problem, and believe me, better to try to get on with your life, on your own, than spending time and money (and it will cost money!!) trying to reverse a bad divorce decree so long after the fact.  Best of luck to you -- I've been divorced 13 years, and just getting on my feet now due to post-decree "wars" from my ex! Don't waste your life over this.
