Is it legal or ethical for a Dr. to charge for transfer of records when the Dr. dropped the patient?

Is it legal and/or ethical for a doctor to charge a patient for transferring his medical records to a new physician, when said Dr. dropped the patient previously because of his own health issues. He stated his condition forced him to cut down his workload. (amount of patients)The patient did not request his records, his new physician did.

It is legally allowable to charge for transfer of medical records....regardless of the reason.   This is standard practice in the medical field.  It usually is to cover the cost of having someone stand at the copier machine or fax machine, etc.   There are specific rules set forth by the medical board in each state that will provide you with answers regarding how long your doctor has to transfer the records as well as charging for them.

Think of it like this, the MD has to pay for a staff person to perform this administrative task, along with any needed materials like paper, copier ink, etc, etc.  Also with the health care privacy laws now, you may have to fax a signed release to your old doctor before he or she can legally release your records to the new doctor.  Lots of pain in the neck red tape with our health care, isn't there?
