yes, unfortunately he can but it is not very polite of him..

if you see him there tell him that you you don't feel comfortable and you will decrease  the money  you pay due to losing comfortable  level. :)

Yes but that's not a good practice, you can talk to your manager about the issue and say your terms about that matter.
