Please help!

 

My son was arrested in rockwall county texas last year for a state jail felony drug charge, in which he was given a sentence of deferred audjucation which was transferred back to oklahoma city here he lives. He recently lost his fiancee due to aids and kinda lost his mind for a while and was arrested for a dui in edmond ok, and then was aressted for possession of a controlled substance in oklahoma city. He is currently in outpatient rehab tx. and seeing a counselor for severe depression. My question is will his deferred sentence be revoked and sent back to texas or will they just let oklahoma city handle it. He has a retained a lawyer and is also attending AA meetings. What else can he do to help his situation? He has a good job and works every day. He had moved to oklahoma for a better life but has had nothing but trouble since moving. Please some one give us some advise. He is in Oklaboma city alone with out any family and is in great termoil because of his loss and now having to worry about this. He admits to a substance abuse problem and wants help.

The most important thing he needs to do is have his family and friends be his support system. The judge will look at his case and his stable background and likely look favorably on him if he's got a family that cares and is willing to look out for him and make sure he stays out of trouble. He should continue in outpatient (or if necessary, inpatient) treatment and if time permits, keep a steady job. He needs to stay away from drugs and alcohol and any previous friends who are associated with that scene. As long as he stays clean and makes an effort at bettering his situation, the judge will look favorably on him and may be a little less strict on him.

The one thing that I know is it is expensive for a police department to expedite an inmate from one state to another.  His attorney should be able to work out an agreement with Oklahoma for him to complete his sentencing there since he clearly violated probation on his felony drug conviction.  However, jake.brown answered below, this will be based on his GOOD BEHAVIOR while in Oklahoma.  You stated that he does not have any family and friends in Oklahoma and he lost his fiancee.  This will be tough on him, because a part of being able to survive treatment, is to have family and friends you can depend upon in times of need.  However, being that the drug offense was a felony and a dui is a misdeamenor, they may require him to return to Texas to complete his sentencing because a felony is a more serious charge than a misdeamenor.  The question to ask is, you are his parent, do you live in Texas where he could complete his treatment and sentencing is probation is revoked?  This could give him the family support he needs to complete his treatment program........
