Is this fraud or just a greedy psychologist

is it fraud for a psychologist to waive a copayment for 18 months and then decide to bill you for it? my lawyer had referred me to a psychologist and the psychologist was reimbursed by insurance and he never billed me or mentioned anything about a copayment until i discontiued treatment. apparently, the psych had made an agreement with my lawyer that he would get paid when the case settled because it was a strong case. this is not the way it turned out and now the doctor is trying to collect over 4,000 of copayments.
