I am trying to to take out a mortage loan on my ...

i am trying to to take out a mortage loan on my house( that is paid for i inherited it) the deed is still in my (deceased) fathers name....in west virginia if you inherit a house you don't have to have it put in ur name...there is a lien on the property ( a credit card debt) that was my fathers and the lien was put on the property aproximatly 2 months after his death....is there a way to have this lien removed???....the amount of the loan i am tryin to get is so low that if i pay off the loan i already have thru the bank i am trying to get the mortage through and have to pay the lien that was my fathers there will not be enough money left to do the much needed repairs that need done to my house

James, you will need to hire a real estate attorney to help you remove this lien and straighten out the name on the deed.  I wouldn't put any money into the home until you have a clear title.

I do not know all the laws in Virginia, but I know that I had once tried to buy a piece of property and before I could purchase it I had to pay off the liens. I know when my husband passed away I did not have to pay any of his debts, but i would check into this more, I wish I had the exact answer for you, but I do not think you are responsible. Sorry I could not be of more help
