My daughter is moving away and my 10 year old ...

my daughter is moving away and my 10 year old granddaughter doesnt want to go with her so my daughter and i have decided in the best for her to stay with me and my husband what would i have to do to be able to keep custody of her, can i get power of attoreny or should i get full custody of her,her mother has agreed on her staying with us.

Becky when I married I had a child form a previous relationship when the time came to move out on my own I tried to take my daughter who went back and forth although I was her mother she wanted grandma because that was home that was her security, If that is what she wants let her stay get a legal gaurdianship and file it at you local court house, but keep a copy for need situations like school doctors ect. That way in an emergency you will have your daughter to help with her. Check into this in you state. I live in South Carolina

I think it would be best if you AND your husband both went to court, and received full custody of your granddaughter.  In the event something, GOD forbid, happens to you, your husband would have a lot less to deal with, concerning your granddaughter, and vice versa.  You will need custody in most states to enroll her in school, take her to the Dr., have her treated for emergencies, ect., and it's much better to be on the 'safe side' and just do it right the first time.

You can swim all day in the sea of knowledge, and never get wet.

You will need to go to court, and she will have to give you all rights . That means you will be responsible for all her medical, and school. Just as if she was your own. I would be concerned why she doesnt want to be with her mother. She may feel she wants it now but later she may not. So temporary custody may work for now. Also a counsler may be a good idea, because she may need someone to talk to other than you about what she is really feeling, and how her life will change without her mother.Good Luck.
