I'm interested in:

A criminal case regarding kidnapping

how can the DA re endict someone on another charge when that person is already incarcerated? and to add further, how can I be charged with something when the wording is changed by the DA in order to charge me? and also how can the police present only enough info in the first place to have me endicted for the first time instead of telling the whole story. And lastly, how can they do all of this when their statements didn't even match the victims written statement against me?

Why do you think the DA cannot do this?  I assume there is no double jeopardy.

Cool Equal justice for All

The law works but the system needs changed, We all abide by the law but sometime it failes us. The same with the goverment. God bless the USA, Brign our troops HOME safely, To the men who did not get the credit they deserve, MAY GOD WATCH OVER OUR SERVICE MEN.

Can i suggest you contact your attorney as this may be a case of Double Jeopardy. as all the facts were not brought to lite in the first trial. But the DA has the right  to make the motion of Discovery and refile against you additional charges during the investagition. As all the facts were not brought to light.

If the person that you are referring to has comitted several crimes, and even if he is incarcerated, each and every charge against them can be brought at any time by the prosecuters office. You don't get away from other crimes because you are locked up for another crime. Michael Joel Held
