What does it mean when someone is in court and the the court sets motion to dismiss?Does it mean they are going to trial or no?

When a court sets a motion to dismiss, the court is planning on dismissing the charges, complaint or for whatever reason the person was in court for.  An order will need to be completed by the Defendant's attorney and signed by the oppossing counsel and then presented to the Judge for his/her signature.  It will also be required to file this Order with the clerks office to complete the file.  If this was a pre-trial hearing for criminal charges, it is imperative that if the charges are bieng dismissed, that an EXSPONGEMENT be completed by the Defendants attorney to clear any information that may linger in the police's information system.  This will protect the person when a background investigation is conducted in the future for a job, etc.
