Is it likely for me as the custodial parent to get sole custody if the non-custodial parent hasn't seen the minor child in over a year, eventhough they requested joint custody?

I think you have a very strong case unless he can prove a valid reason for not seeing the child. Go and get professional advice and you can then move forward and apply for sole custody.

yeah, I think my lawyer wanted to establish a pattern of non-compliance so we an present that to the judge. I haven't seen or spoken to him in over a year. He didn't even come to my son's 1st birthday. He last saw my son when he was 5 months old. He doesn't want anything to do with him, he just put on that phony show for the courts. He is a correctional officer, do you think the judge will be more likely to rule in his favor or feel more sympathetic towards him beause he is an "officer of the court"?
I am sure the judge will look at him as a father and not an office of the court- try not to worry!
well in my case we was not married and did not have joint custody i had sole custody.he hasnt seen him since he was 2 weeks old there were times when he would not come to visit bc he said he should not have to make an appointment to see his own son.and he did not want to sign the birth certificate bc he didnt have his last name he had mine.my son is now 5 and my husband signed the birth certificate when he was 1.I later got married.But in the state of tn if the father does not see the child whithin a year his rights are automatically stripped.
