My neighbor was given permission to use our truck for 1 day. After several attempts to contact him with no responce, we reported it to the police. The police are listing the truck as unauthorized use when I would consider it to be stolen after the time frame in which we stated to him that he could only use it for 1 day. When is it consider stole in the laws eyes, its been over a month in a half??
If this guy is/was a neighbor, I take it you have not seen him recently? It's not like he's at home and just not answering the phone?
I might go to the police station and ask to speak directly with a detective. Explain the situation to someone who hasn't heard the story already (patrol officer) and you might get a completely different response.
This might part of something much bigger if your neighbor has gone missing as well.
Failing all that - and if you know where the neighbor is - I'd try suing him in small claims court for the value of the truck. It would get someone out to his house to deliver the paperwork (they could see if the truck was still there) and get him/her into court to explain why they haven't returned it yet.
Raise a fuss and you'll get results.
I think what they charged them with is just as good a charge as stealing it....but they will probably upgrade charge to theft of a vehicle if it does go to court...this is the answer from a friend of mine who is Chief of police of a small town....best answer i can help with...Good luck in getting vehicle back
