If you bail the person out of jail with your own money, you get it all back, as long as they go to court. If you go through a bondsman, you only pay a percentage of the bail, the bondman pays the rest, and when the person goes to court, he gets his money back, plus your money as the fee for his services. Otherwise, you would be responsible for the total amount of the bail. US Supreme Court ruling in Taylor vs. Taintor 1783 gives any bail bondsman, or his agent the right to persue and arrest any person whom he has admitted to bail. The taking into custody is based on the original charges and no new process is required. It would be the same as if the sheriff or police in other cases were ot take the individual into custody on the original charges.Good luck!

what is the process to bail someone out and have them in your custody?

 

I'd call All Estates Bail Bonds, they are a Nationwide Network of Professional, Licensed and Insured Bail Bondsman and Bail Surety Agents who cover the entire United States.  The staff is extremely courteous, helpful and will answer all of your questions.  They don't seem like they are trying to make a quick buck off someone else's misfortune, unlike most of those other bondsmen out there who just aren't friendly at all.  I was referred to All Estates a few months ago from some friends who had great experiences with them, and I've referred them along myself to some friends who had equally good reviews.  Highly recommended.  Their website is http://www.AllEstatesBailBonds.com and their toll free number is 1-877-WHY-JAIL.  Good luck!
