In an accident, other driver claims he's not at fault, I claim that I'm not at fault.  No Witnesses & the Highway Patrol could not establish who was at fault.  My insurance is paying for my medical, they paid for the Total Loss vehicle, because I do have full coverage.  Who then will pay for my pain & suffering?  Lost of wages? Do I have to sue my own insurance company to get it?

Hi,
In such a case the court will decide who is responsible.....  That can be done by analysing the marks on the cars and the drivers descriptions.  You can sue either your insurance company (that's the best), the other driver's insurance company, or both.  In fact don't do it by yourself, better take a good atorney that will do the job for you.
