been together 28 yrs. never married, have 1 son together with my last name..how does my boyfriend protect the home from going to his mother, sister, etc,,,an how does he make sure it is going to our son??? the house is in my boyfriends name only but to avoid probate in any way, what kind of will should he have so it goes to our son....is that clearer???
That is much clearer. Basically what needs to be done is your boyfriend needs to have a will made up outlining exactly what he wants done with his assets should he die or something else happen to him that he can no longer make decisions for himself. He can go to an attorney to have the will made up (however this can be pricey) or he can make up his own legal will at http://www.legalzoom.com/.

what happens if he still owes a mortgage an its in his name only???
If he dies and still has an outstanding mortgage, his assets will be used to pay off as much of the mortgage as possible. If there is any money left over, it will be dispersed according to this written wishes.
