The PRO-IP Act would toughen civil and criminal laws against counterfeiting and piracy, provide enhanced IP enforcement and prosecutorial resources, and improve IP coordination within the executive branch. Critics of the legislation, such as the Electronic Frontier Foundation, say the Act still fails to differentiate between commercial pirates and ordinary web users. People who reasonably believe that what they are doing is a fair use, for example, shouldn't face ruinous liability if a court doesn't agree with them, said the EFFs Richard Esguerra. The EFF believes the sponsors of the bill are more concerned with protecting outmoded entertainment industry business plans, than with protecting copyright from violators.
