Who's at fault?

I was driving in a store parking lot and observed an employee pushing carts across the "driving lane" through the parking lot moving from left to right.  After he gets to the right side out of the way (parallel) to the other parked cars, I proceed to drive down the isle to exist the parking lot, when I get part way up the isle he steps backwards about 2-3 steps and bumps the side of my car.  I was driving a max of 5mph and had witnesses in the car with me.  Now he claims to be hurt and is trying to get money from my ins.   Who's at fault?

This may not be an issue of fault. An “accident” occurred. He has every right to file a claim against your insurance. Whether he’s hurt or not is an issue that will have to be proven.

Victims of circumstance owe it to fate. Victims of choice owe it to themselves.

Obviously, he is. But Mr. J has given you the "correct answer".

You might consider asking the store manager the reason that their store hires such litigious individuals. Better yet, have your lawyer make the inquiry. And if the plaintiff is still working, how bad can his injury be?

Consider a counter suit for not paying attention, dereliction of duty, and having parents that were not thrown out of the gene pool.

Or consider having Don Giovanni pay him a visit-

I truly hope that this is resolved quickly and in your favor.
