While visiting your attorney about legal action against your husband's mistress , also start proceedings to remove him from your life .  Find a honest , loyal man who knows how to be a man and that actually loves and respects you and enjoy the franchise with him .  You Go Girl , Good Luck .

You can sue anybody anytime.

 

Why you want to sue her? Your husband is the one cheating. A partner usually won't have an affair unless there are issues in the marriage. (Unless he has some sort of sexual addiction and if this is the case you should get out of the relationship) He may feel you are neglecting him or no longer stimulating in some way. He chose to do this for some reason. You need to find out why then decide if your marriage is salvageable. Taking her to court won't solve your problem.
