State Tax Problems

My father died sveral years ago and left my sister and I a cd, which we split and annunity, which we split...10,000 and 50,000. We were told at the time that it was an inhertiance and no taxes were due...wrong, wrong....Now, the state tax department sates I own them approximately 3,000, which most is pentleies and late fees. Now they are trying to take my money out of my husband's checking account, it is not a joint account, which of course we cannot afford. So can the state tax department take money out of my husband's checking account?
