Service Tax related matter

We are manufactirer exporter in India during the year 2008-09 We have paid foreign commission to our foreign agents. Excise department's auditiors says that you are lible to pay service tax on the amount which you have paid & get back cenvat credit the same.

AGCR Audtiors says that we can't take the cenvet credit under rule finance act 1994 secttion 66.

Is that possible please reply.
