My 19 yr old daughter was in a car accident 5/29/2009. The police were called and filled out a non-reportable police report and was told by other driver that is was his fault because he didn't know the area and thought he could make a right turn from the middle lane. He changes his story once he talks to his boss and insurance company and they deny our claim. We asked police for their help by writing a statementand we asked why he didn't get a ticket, police said they didn't even have to show up at the scene causeno one was hurt and they don't get involved in stuff like this, pa is a no-fault state. I want to file a claim in small caims court against the driver, who should file the claim...My daughter the driver or me because the car is in my name?

Open the pod bay doors HAL

You own the property that was damaged so I think you are the one to file the claim.
