I'm asking on Yedda because it cost me more money every time my attoney sneezes. I'm hoping to keep the cost down, that I may not be able to get back.
I am a heir in an estate that has been open for more than 18 years. The Personal Rep. has did not maintain the property and used the proceeds from rents for her personal use. The attorney for the estate has delayed the process by not showing up at mediation and not abiding by the judges orders to the point that even the judge wrote of incompetence. My question: Is their case law, and where would I find it, that would allow for my attorney's fees to be paid, either by the estate, estate attorney or by the PR? Because of my attorney's actions, it has saved the the estate and therefore the other heirs more than $40,000, but it has cost me $8,000. I live in Florida.
