Quotations and VAT

hi,

If you get a quote for a service from the UK and the quote does not state if VAT is included or not.

Does it automatically mean that this is inclusive of VAT as in other countries?

No. There are all sorts of things that affect whether VAT will be charged. Where is the service being performed? What sort of Service? Is the service being supplied to a business within the EU?

If the service doesn't attract VAT, for whatever reason, the supplier might not mention VAT. If I was quoting for services to be provided to you in Malta, and you are in business and provide a VAT number, I wouldn't charge you VAT, but I would tell you so and why. But as I'm a VAT specialist, you'd probably expect me to...

Thank you for your fast reply.

Perhaps my question was not clear enough. Malta is in the EU and therefore we are subject to VAT. My question is a bit different, so I will rephrase.

A provider sent a quotation for a service, say 200 pounds, without stating if this figure included VAT or not.

When eventually the invoice was presented the provider requested 236 sterling (i.e. 200+VAT).

In Malta and in several countries I visit, if you do not state specifically that a quote DOES NOT include VAT then the law assumes that VAT is ALREADY included in the quote.

How thus this work in the UK?

Thanks for the clarification. 

I think you would need to check the suppliers terms and conditions to check whether a price quoted is inclusive or exclusive of VAT. I believe there is a requirement under consumer, not VAT, legislation in the UK to make it clear whether prices shown in shops include VAT. (I'll have a look to see if I can clarify this after the New Year holiday).

For Business to Business in the UK quotes are often given without VAT on the assumption that the recipient of the supply can recover the VAT.

The supplier's terms and conditions were not provided with the original quote and I am sure of what they would say if I ask for it now.

The service was being provided from a Professional to an Individual and therefore Business to Business agreements do not appear to come into this.

I would appreciate if you have some further clarifications or if you can point me to some web site dealing with these issues.
