Parenting Time Help? Custodial Interference By Father....

I have a 2yr old and a 1yr old, was never married to the father, we lived together from nov. o7 until oct 08, he moved about 2 hours away to go to rehab after finishing a 2wk rehab program he stayed up north and lived on his parents property. I allowed him non-court ordered visitation, well at the end of may 09 he did not return the kids as planned so I went to get them, he took off with them, I called the police and they said I needed proof that I had custody, so I had to leave and come home and go to the courts the next morning and get proof, so I got an Ex-parte order for the immediate release of the kids to me, with enforcement by law if needed. So I went to get my kids. Well we got there and the cops did not enforce it, and eventhough my son was in the window screaming for me, and I had the orders signed by a judge, they made me leave, so I stayed in a hotel for the night and my ex and I were texting and he was telling me that I would not see the kids unless I changed my order giving him joint custody, and so on... Well the next morning, I was served with papers saying he was going for full custody and if I wanted to see my kids I needed to go to his lawyers office and discuss this matter. So I went and the kids were not there, so I was forced to sign joint custody papers, I would have signed just about anything at this point just to get my babies back, they had been gone now for 10 days 5 for the allowed visit and 5 extra that they kept them from me. So as soon as I signed my kids were there and I left came home got a lawyer, and I know have got all that I signed there dismissed, however it is now being contested over the visitation, we are going to friend of court for a parenting time review, and my ex is trying to intimidate me by saying he has 3 lawyers and all this dirt on me, which is crazy because I have a ton on him, but I am not even wanting to go there, all I want is what is best for my babies. So after all of that , this is my question, what do any of you think is a good visitation for a 1 and 2 year old and I know the formula for FOC already but the courts are going to want something more that that because of how far he lives ,so maybe every 2 wks he gets 4-5 days, IDK I am not sure, any suggestions? Also what do any of you think can be done as far as what happened to me not having my Ex-parte being enforced? I was told the cops were paid off, because my ex's step-dad is well known in town. I am just so confused, yes I have a lwyer, but it is through legal-aid, because it was the fastest one I could get as soon as I got the babies home, but she will not call me back and inform me about what to do at this mediation at FOC....please help....

What did you lawyer say? It sounds like you need to get a good one who can walk you through the whole visitation/support issues. The father is "lawyering up" so unfortunatley, so should you.

Cool Equal justice for All

The law works but the system needs changed, We all abide by the law but sometime it failes us. The same with the goverment. God bless the USA, Brign our troops HOME safely, To the men who did not get the credit they deserve, MAY GOD WATCH OVER OUR SERVICE MEN.

As i read it you went to your EXs attorney and did not have your attorney present that was your 1st mistake any time child custody is in despute you should never use only one attorney such as his as you will come out on the short end of it. The next problin i see is that we have more than one state line involved and this makes matters worse as state laws very from on state to anouther. as in most cases do involve state lines and who has the most jurist dictation.

Yeah, in the window just scream yourself. It's always been that way and that's the way it very likely will stay

Hi Missi, unfortunately in divorce parents often make the terrible mistake of using their children against each other. Please check this site out and get their Free report " The 7 key mistakes made by Parents Separating & Divorcing" it really helped me. I even sent it to my ex to read so we both understood the harm we were doing to our children. http://singleparentsuniversity.com
