When is a painting not a painting?

Embellishes them, and calls them original paintings. Am I wrong? Shouldn't paint on a painting of "painting" specifies how the paint is to be applied, only that the work is done using paint not be a legal definition of 'painting' I don't know... but in my book, a hand-embellished a giclee
