Outstanding warrant and DUI case in MA

I have an outstanding DUI case stemming from a Spring 2005 incident. I was driving after drinking and crashed my car into a telephone pole. After, I got out and started walking alng when a police officer asked me if the car was mine (it was very late at night). I answered that it was indeed mine and that it had been a female I had met at a bar and had fled as soon as she crashed. The officer administered a field sob test which he deemed I failed. At the police station i refused the breathalyzer and asked for a blood test to be administered. They said it was not allowed in my situation and booked me. I maintained that I had not been the one driving and that it was this girl's fault. When asked for her name I said I only knew her first name and had just met her that night. Supposedly, they said someone had seen me get out of the car immediately after the accident although I highly doubt that as it was a early Monday morning at approx 3:30. I was arraigned and ordered to come back at a later date. At the pre-trial cnference I asked for a extensin...twice. On the third time I s didn't appear and I'm sure a warrant was issued. Simply put, I was scared and just didn't know want to deal with it which I realize was not smart of me. Fast forward to the present. I have yet to reslve this issue. I did see a DUI lawyer a few months back and he explained that I had a pretty good of beating the case based on the fact that no police officer observed me driving erratically and there are no breathalyzer records. He also pointed out that they may have trouble locating and issuing a summons for the "witness." At this point I just want to resolve this issue and put it in my past. I do have a 1st offense from a number of years ag that resulted in a continued without a finding verdict. I simply dn't have mney to hire a private DUI attorney. I've been thinking about turning myself in and resolving my outstanding warrants. My main question is wuld it be possible, or for that matter recommended, to try my luck with my a court appointed attorney in the hopes of maybe getting the charges dismissed from the get go given the lapse of time? If not, could I then switch attorneys before the trial and smehow try to fund the money to hire a private attorney? More then anything, I want to avoid another strike on my record and possibly serve jail time. Thank You so much in advance

It is hard to say what the status of your situation is, but seeing as how you just stated in writing and in public domain that you were driving at the time of the accident, you may just be SOL . In my opinion if you were DUI and the one responsible, you deserve what you get.

Your best bet now is to fess up, turn yourself in and plead guilty. We do not need your type on the roads.

Thank god you did not hurt or kill anyone.

In fact dumb a** I am so pissed at your admission that I copied this admission along with your login information and am forwarding it to the Prosecuting Attorney of Massachusetts in the hopes that  they nail your hide to a telephone pole.

I am sure that I will receive much flack on this comment as it is out of character for me but I could care less.

I'm in school to get my degree in Criminal Justice. First, let me say that the police are allowed to lie to you in order to try and get you to incriminate yourself. They probably lied about someone seeing you getting out of the car. If someone really saw that, they would have stopped to see if you were ok since you had just hit a tree. Second, when you signed to get your drivers licences, you agreed to take a breathalizer test at an officers request and if you refuse you agree to having your licences suspend and an automatic DUI. Your story with the girl would have probably worked REALLY well had you not failed to go to court. That just killed your credibility. See the state would have to prove that you were driving and since you were out of the car you probably would have gotten off. My advice would be to turn yourself in, go to court, use a Public Defender (they will argue the same things that a paid attorney will) and maintain that the girl was driving and took off. The only real thing they could do would be suspend your licences which is better than having a criminal charge. Good luck. kristykellymail@yahoo.com
