Hi, I have primary custody of my 10 year old daughter for the last 5 yrs. Her father works shift work, various hour night and day and his girlfriend would be taking care of my daughter 1/2 of the time if he were to have her. I am a stay at home mom. She also have a son with the current man I am with. My finacee is moving to London, UK. For a promotion in the Canadian Navy. We want to take my daughter with us. My ex of course, does not want her to go. He currently sees her 9 wks a year split up every second weekend and 2 wks in the summer. I am offering him 9-10 wks a year just layed out at different times, holidays and all summer, etc. Her father loves her, but he has never made it to a parent teacher, I have never missed one in 5 yrs. I have worked with her to improve her schooling to almost straight A's , We both have lawyers and now will have to go to court to see if he can stop me from taking her to the UK. If I don't go then my husband must go with us and we'll have to stay back in Canada. We have a very happy , secure family and her step dad is very active in her life. What are the chances I can take her???????
Dear Maiden,
My personal advice would be to go for it, as improbable things often come out of Judges' mouths, and in consequence, in their orders. I advise having all documentation to prove each and every contention that you have, tell the absolute truth about everything, and let the cards fall where they may, assuming you can afford the legal process, which I can only guess is much like the US, slow, expensive, and cumbersome.
My advice works, as evidenced by the award of custody to me( the father) in a state(georgia) where, at the time, the chances of a father getting custody were less than 1%. Almost fainted when the judge announced his decision that day.
