Older Workers Protection Act Effective April 15, 1991
I was a management employee on Long Term Disability from United Airlines when they filed for bankruptcy. At that time I was collecting a long term disability check from Uniteds carrier Cigna Insurance and receivng social security disability. At the time of their bankruptcy (United) involuntarily retired me and I was told by United that my retirement pay from them would not be an offset to my Cigna Disability check until I attain the age of 62 due to the OWPA of 1991. Is this true? Further, Cigna was paying me my full disabiliy benefits until they helped me get social security disability benefits. Then they substracted the amount I was getting from social security from the monthly benefits they (Cigna) were paying me. Is this permissable under the act? Are ther any other rights or offsets I can claim under the act. My disability carrier (Cigna) after 16 years of being totally disabled are giving me a very hard time regarding these issues. I would appreciate any advice you could give me. Should I retain an attorney?
