Neighbor infringes on sale of home - depreciating by being sloppy, inconsiderate...

Neighbor sues neighbor for real property depreciation damages and wins in New York State - They (My neighbors) have basically infringed on the sale of my home by reconfiguring their property, destroying the road to my home (the rest of the public road is in tact - they crushed 40 years of pavement). And are generally slobs....  The only messy ...unsightly home on this dead end road. My home is the last one on the road, and I land lock the road on all sides. I have asked nicely for them to clean it up for years to no avail, then went to mediation in Feb, '09. The municipality said they (in legal transcript I have copy of) they would repair road, but only patched it. Neighbor verbatim in same transcript says: "...I can appreciate the position we put Ed in...." ( I lost sale of my home in 2008, buyer cited conditions at the above location - as have vendors ... fuel delivery, etc.)  Please advise ! Thank You !

Kent, as a home owner also living on a private road this is an interesting situation (I know that's not your word for it) but it seems like a legal question to me. I suggest you contact an attorney specializing in Real Estate matters for the best answer.

Kent, my situation is a little different in that I'm in an area controlled by an HOA and my road repair issues have been with them and the Board of Directors who determine where road repair will (also meaning will not) occur. It took several years of badgering but last year they finally got to my street. I wasn't happy but at least I seem to have some recourse but I'm not sure you do. Hopefully your attorney will have something positive for you to hang your hat on.
