Needlestick injury from nurse to patient after contaminated needle used to give flu shot

center for disease control/ needlestick injury- nurse to patient. Patient hospitalized for 3 days for infection after a contaminated needle was used to give flu shot. Is nurse obligated to follow needlestick protocols to test for anything she may have transfered to patient? Patient home, with open injuries which require wound packing daily for 3-4 weeks and antibiotics taken orally. Please advise patient rights regarding this injury. Thank you!
