Oh, believe me, I have searched and searched. In MD there is a $250,000. cap on med mal lawsuits, but I believe there is not on the emotional harm, torts,etc. The physicians know that no attorney in their right mind will take a case unless it is the death of a person, due to the costs vs. the amount they will make after expert witnesses and other overhead costs.
I can't even get past the initial email with the attorneys. If I could and they heard all of the damage that has been done to not only myself but mostly my children, the fact that they would not need an expert witness because one of these physicians has hung himself with his own charting and I have copies of the redundant toxic tests that state I should be tested further but was never given the opportunity to do so, my doctor has been writing for 7 years now, that I have tumors that are very painful and spreading through out my body but he has done NOTHING to help me get a diagnosis for them so I can get better, he just puts me on 22mg of IV Dilaudid to cover up the pain. He's put me on blood thinner, Coumadin/Warafin, and he doesn't even have record in my medical chart of doing so. I've been taking it for 1 1/2 years and he has not sent me for an INR test to see if I am taking enough or too much. Coumadin is a drug that can kill a person so quickly if their INR levels are not monitored. Anyhow, instead of doing the right thing and givin me a referral to the local coumadin clinic to check my blood levels, he yells at me for him not remembering prescribing it to me and because he has no notes in my chart of prescribing it to me and for what.
If that is not a med malpractice suit, I don't know what is. It boils down to , physicians do not care about human beings and you have to die before your family can sue for med malpractice because attorneys do not help save lives, they collect money. I've even offered attorneys $$ to just write a letter to this physician to threaten him, or give him an awakening, and I get no response when I throw money at the attorneys. On the other hand, I know of a woman who goes into a local grocery store, falls down on purpose, and she is suing for millions. It was faked. Wheres the justice in America? I am so sorry to hear about your plight. I wish I knew someone but unfortunately, I don't. I can't imagine though that if you tried to file something with the court against your doctor, that the court would turn you away. I would think the only thing you need to prove your case is copies of all of his medical records. Maybe at that point, the court will force an attorney to represent you against this doctor (as I'm almost 100% positive every doctor has malpractice insurance that would cover the attorney fees on the doctor's end) and this would put you on a fairer playing field. If that doesn't work, I hope you find another doctor who can treat you and find out what's making you not well. Good luck!
