Mortgage Loan Modification? What do we need to do? Please help.

Hello, My husband lost his job last February due to downsizing and the same happend to me in May. We have used up all of our savings and we are now 3 months behind on our mortgage. Our mortgage company said we must have jobs before they can help us? Both of us have been actively looking for employment nearly 27/7. My husband just acquired employment through our county and there's a good chance I may have employment too. Both of us hopefully starting in the next 2 weeks. What are our options to save our home? find out where you are in process. Did you get an NOD yet (notice of default) ? If so what is your state law on how much time from NOD to sheriff sale ?  Look in public records to see if a foreclosusre case has been filed.

Most important is don't leave your home. Chances are your lender sold your note and has no "standing" to demand payment let alone start any foreclosure proceeding.

what your lender didn't tell you (most won't tell you because they are crooks) is that they will accept unemployment benefits for loan mods.

keep in mind the govt option HAMP (obama housing plan) is just above useless and has only helped 1,700 of the projected 500,000 targed by end of october. this follows the Hope 4 Homeowners under Bush that was a failure as well.

Non-profit has no real solution and it's important to get educated on the "where's the note" strategy. 

know that over 95% of foreclosures in america are done Illegally and congresswoman marcy kaptur of OH knows the game as well and has advised homeowners in public on the floor of the House to "squat"  if foreclosed on since she knows the game as well.

unfortunately most homeowners pull up the uhaul since they are uneducated and assume there is nothing they can do.

stay calm, hold on to your cash get educated and know there are options to stay in your home.

possession is 9/10's of the law and the other 1/10th is attachment. if the lender has no note there is no attachment. the house is yours not theirs.  keep this in front of your mind.

First of all it would be better if you can provide some more details here. How much mortgage you took, how much is paid off and how much is still outstanding? Your first and foremost fear should not be about your house but about your daily bread and butter. Concentrate towards getting some job, if not a full time, try to get a part time job. At least this cold help you somewhat with your daily expenses. Meanwhile you can also consult a good financial consultant in your area and he may give you a good solution for your problem.

Cant agree more to what Jerome and Toddw said above. You should first emphasize on fulfilling your daily requirements. There's also no harm in taking a part time job, if you are unable to get a full time job.

well, you posted this 24 days ago so hopefully you have a job by now and your bank works with you. 

Be advised, and it is unfortunate that banks give you a higher rate than if you did it through a loan modification company or real estate attorney
