Not a slogan, but I am advertising I guess, for physicians that will help me get a differential diagnosis. I have been chronically ill for about 10 years and I have become ill with many different strange symptoms. I have had a few diagnosis but I have been refused treatment for the diagnosis. (small town, only hospital in county is just a triage hospital). I will accept invitations from any physicians/sprecialists, wo is willing to help me figure out what I am dying from. In the mean time, I will do as I have been doing, and continue to help others. God Bless.

Md laws or just rights, to be prescribed opiodes for chronic pain patients

Are there any laws, not rights, in the state of Maryland that help people in chronic pain obtain opiode pain medications or continue to obtain opiode pain medications from a provider that has been prescribing the same opiode medication for many years? Everything I read is about protecting a physician, but the 70 million Americans in chronic pain, not acute, are suffering needlessly. There are rights but they are not laws and the hospitals and physicians know this. There are caps on lawsuits in MD, and the physicians know this and treat patients, myself, inhumane. I believe if I were an animal I would have more laws protecting myself and the vet to obtain opiode pain medciations. The stress of going to a hospital or consulting with a new physician is unbearable for me anymore because I know that it will end in a failed appointment as the physician will not take me as a patient so I can try to get a differential diagnosis instead of eating opiodes and dying. No physician wants a patient that is "chronically ill" (longer than 6 months), because they may have to spend more than the what I have been told, 7 to 14 minutes per patient. HMO's have changed the whole health"care" industry. It should not be listed in the humanity field anymore. I have been abandoned by the only physician that actually has seen me degenerate from ? disease/condition over the past 10 years, and he stopped prescribing all medications including steroids that keep me alive and opiodes that he used to in hindsight, just shut me up about the pain I have been in. He had me on such a high dose, if I did not find someone else to write the opiode prescription temporarily, I would had never seen withdrawal, I would have gone into shock and died first. Because of the situation that he left me in without discharging me for anyt illegal activity or violation of my contract, no physician will take me as a patient, not even an Internist or General Physician because I am his trash.(He has also "failed to act", "failed to inform me of a diagnosis that has caused me permanent damage to my organs", he has missed diagnosed me, misdiagnosed me, lied and much more. I cannot even PAY an attorney to write this physician a letter letting him know of the tort actions, and other lawsuit actions that I could stir up for him. Why is this?  Anyone can reply to this question or my statement.  I would love to hear from an attorney, physician or someone in the healthcare industry.

I've been there with the attorneys as my 11 year medical maladies, that have been ignored, have snowballed to such a state that my husband can no longer work, he is my "Hospice caregiver", my GP told me that he gave up on me over 6 yrs ago and he will not give me my 7 medical charts, all of the specialists that I had, have abandoned me, and all that I have is a pain management physician for now. I am not even on top of the pain that the physicians know what started this whole body system failure 11 years ago, but they failed to inform me, as they have done so many things with malice of forethought. I have been denied surgery for a diagnosis which is the only treatment or my body will continue to deteriorate. I was told that I have to be sicker, before they will even recommend surgery. I had this same surgery in 2006 and the surgeon stated that I will have to have this surgery repetitively the rest of my life. If he was only still around. I cannot get ANY physician to look at the signs on my body, and the symptoms that I suffer from and take me on an out-patient basis. I cannot go to the ER for the extreme pain and symptoms because they tell me they cannot help and to see an out-patient physician.

I've called attorneys for years and I cannot even PAY an attorney to help me. I believe I have to die from the misdiagnosis, failure to act, failure to treat, missed diagnosis, intentional malice, and so much more. I have been to over 100 doctors easy and I know that I have spoke too or emailed over 100 attorneys and nobody wants me. Not even for money. The physicians are getting their money and they do nothing. A consult for me is the doc walks in, says a few things, I never get a chance to speak and they walk out and bill the 2 good PPO insurance companies tht I have. Sometimes I believe they are just using me as a quick consult to get paid. I know the medical industry has changed to "how many patients they can consult with in one day to make the most money" and they do not even "care" about a persons feelings after treating the person the way I describe. It truly sickens me and I believe it is dispicable for the doctors to be able to act any which way they want and the patient have zero rights. I thought that we have a right to live?

 

Thank you for answering. I am so lethargic, weak, and in pain that I cannot even make it to out-patient appts anymore if I had a physician to go to.

I am so sorry this is happening to you; the medical community can be awfully inhumane.  First, I would write a letter with as much detail as you can include to the MD State Board of Medical Examiners specifying your complaint(s) with the physician who fired you.  They must investigate--particularly if you use your name and not go the "anonymous" option.

Second, I am unclear as to your diagnosis.  Could you articulate it further or provide more details of symptoms?  You are right that most doctors don't like to have patients they can't "heal" within a few months or so.  And, more and more, are getting freaked out by the State and Federal governments monitoring how many opiate scrips they are writing.  Too many and the doctors are investigated.  That doesn't excuse what's happening to you whatsoever but I know it's a huge concern and the documentation required is extensive.  Please take care and, again, if you could provide more information about your condition perhaps I could help further.

Here’s my answer straight up without pulling any punches. Frankly, NO, there is nothing on any books in Maryland or any other state that says if someone asks a doctor for opioids, or any other medication, a doctor has to comply.  As for writing to MD State Board of Medical Examiners as someone suggested would be an exercise in futility on your part. The only thing that will get you is more frustrated and aggravated than you already are.

Reality check; in this case you have no creditability. Try looking at this from another view. Here is a person who is poor (as in no money), can’t afford to hire a lawyer nor doctor shop. No professional degree’s and no notoriety of any kind. Writes a letter to a medical board (another doctor) complaining about another doctor who doesn’t want to prescribe a controlled substance to them (we’re not talking about vitamins here). So who would you believe? From your post you come across as a whiner, and a drug addict. All a doctor has to do is say that in their professional opinion you pose a high risk for addiction, overdosing, and are unable to take medication as prescribed. GAME OVER!

I think what you need to do is check into a inpatient drug treatment program before it’s too late and you find yourself on the street looking for heroin, and doing whatever it takes to get the money to get yourself off of sick that day. Or perhaps find someone who will sell you what you want from their prescription, until they decide, they don’t want or can’t do it any more.  I don’t mean to sound harsh but one no ever said life is easy, and I speak to you from personal experience. Unfortunately, no, there are no laws on your side except that you have a legal right to your medical records. They absolutely cannot be withheld from you.

No doctor has to treat you other than in an actual emergency. You might be able to find a "pill mill" that gives opiates to everyone, if and only if you have absolutely no history of substance abuse or anything in your medical records that might throw up red flags with the FDA, including abnormally high doses of medications. If you are on the high end of normal dosages, or you don't have a referral from another physician, it's unlikely that even they will take you, because they are the last practices that can stand any scrutiny at all.

It is, however, possible for people with chronic pain to find treatment. You say that you have a pain management physician, so obviously you have some treatment. I have chronic pain issues, and while I'm not entirely happy with the treatment I've found, I haven't had a problem with finding doctors who will accept me as a patient. (Caveat: I live in Atlanta, Georgia, where there are many, many physicians of every imaginable specialty!)

Have you ever read Full Catastrophe Living by Jon Kabat-Zinn? I recommend it (it's also available as a good audiobook). It's available from most libraries, too. Kabat-Zinn's approach is used in many multi-disciplinary pain treatment centers to help people learn to cope with pain.

Have you applied for disability? While it may be difficult to get a lawyer otherwise, it isn't usually difficult to find a lawyer willing to take a disability case, and they would then help you get your medical records.
