How does a person living out of state, whose wedding was in Ellicott City, Howard County, MD 14, years ago, get an uncontested divorce without paying anything other than the required court costs? One spouse still resides in Maryland. The couple have been separated voluntarily for more than 2 years. Most, if not all assets have already been divided.
save the starfish
Frist you need form DOM REL 20 which you pick up at the court house. follow the directions.
the person that lives in md has to be the one to file. as you have to file in your home county, not the one that you were married in.
it also says that there are several reasons that you might need an attorney, you have been married over 10 years
"you have been married close to ten years, Being married for ten years may entitle you to certian benefits" straight from the forms.
line 12 gives you grounds for divorce, and your two year separation is one of them. "there is some important things to remember: during the past two years, if you and your spouse lived toegetehr at all, or if you have had sexual intercourse with your spouse during that time, or if you spent even one night under the same roof, you can not get an absolute divorce based on the two year separation"
you will also need a witness to go to court with you to testify under oath, on the grounds.
as for fees " there is a fee which must be paid when you file a case. the fee may vary depending on whether you ar filing a new case or reopening an old case. The court may also chard a fee for other services such as having the sherriff's department serve your papers on the ohter side, co parenting education and mediation. These fees vary. Ask the clerk to tell you the amount of all fees and when the fees will need to be paid."
the packet is big. with a ton of info requested.
hope it helps
