I am not sure of the LAWS in the State of NJ, however in FL, the patient has as much burden on them, as the Physician has in seeking/calling for the results!
With the numbers any Physician takes on in these times, a delay is always expected. If I were the patient, when the tests are done, whoever performed the services, I would have inquired of THEM, when the Physician should have the results, and take on the responsibility, for my OWN wellbeing to make the call to the Physician, or a follow up appointment, and obtain a HARD COPY of the report, which you are entitled to. THEY ARE YOUR MEDICAL RECORDS.
In the State of Florida, the Florida Departmnt of Health, Quality Assurance, is the Agency arm that handles discipline of any physician who has misdiagnosed. misprescibed, negligence, abandonment, etc., and it follows an investigative process. If there is due cause, it is forward to the Office of the General Counsel/Prosecution Unit, and the State Medical Board files an ADMINISTRATIVE COMPLAINT and the physician has to undergo further questioning, disproving allegations brought against he/she.
I have involved in this procedss right now. Additionaly the physician went before the Peer Review Committee Hearing at the Hospital where the incident occurred and was heavily fined/and his privileges TERMINATED!
There is an exact process that needs to be carried out to the inth degreee. DOCUMENT, DOCUMENT, DOCUMENT~~~ is your defense to PROVE beyond a shadow of a doubt your allegations. I have.....and I expect stellar results.
