I was arrested on a new felony charge back in 2006 while I was on active Parole. No bail was set for me at 1st pending arraignment in Supreme Court.In the initial stages city court dont set bail when a felony is involved.That Judge arraigns you and then you're shipped off to county jail pending court proceedures there. At my arraignment in Supreme Court a bail was set. Everybody is accorded a bail.Then the Parole warrant kicked in.The Parole detainer had been active and in place upon my original arrest date 2 weeks prior.I know ppl on parole can NOT get out on bail BUT once that parole warrant become active certain time limits become involved,certain procedures become effective,etc..When My parole warrant became active ,was that time right then there and there & forward supposed to be counted as parole time or delinquent time? The 313 days I served in County jail ,about 300 of them were with the parole warrant active.Because had it not been for the parole detainer once my regular bail was set & if I was able to post that bail I would of been home pending future court dates..So again Should the 300 days be counted as regular active parole days or should they be considered delinquent time & added to the end of my parole time? Please help..any and all answers will be greatly appreciated..
