Not sure if there is an exact answer to this question .. ever law seems to to utilize this presaumption however all i can find as far as coining the exact term is - William Best (1809 - 1869 ... on Presumptions) .. check it out

In dubio pro reo is a Latin legal term that means "When in doubt, in favor of the accused." This in lay terms is roughly equivalent to "Innocent until proven guilty."
