Injured on the job-need advice as to what i should do.

hi,,

I was injured on the job,,not by any means on my part, i was a victim of someones negligence.

Now I am off work due to this,

and the result of this injury is that I have torn muscles in my arm and must have surgery,

I am in pain 24/7, meds dont help much.

as of now I am waiting for approval to see orthopedic surgeon, and the doctor that has been treating me has taken me off work right now unti Jan. 2010.

I have never had anything like this happen to me, I am totally unfamiliar with Workmens Comp and how they work, I do not know what to do, about this I need to know if anyone can give me advice on to whether I need/should get a Workmens Comp lawyer to assist me wit this.  Do I have a case?

I am missing out on my wages, not to mention the pain I am going through,

I have worked for this company for 8 yrs.

And hve never in the past been out on a job  related injury,,

Please help any advice would be greatly appreciated.

I am in California, in East County.

Thank you much!

Yes by all means obtain a Lawyer who specializes in workman related accidents.  It will be to your advantage. I also recommend that if your doing any thing out side, like putting out or bringing trash barrels or any heavy lifting, to not do it.  Once you obtain an attorney they will be watching you and taking pictures of you.  Even bringing in grocery Anything you do with your injured arm.  They want pictures.  They can photograph you from several blocks away or from the air.   You must not use that arm for anything.  Good Luck and Hang in there.  Remember they may all ready be watching you.
