Lisa, if you feel the homeowner was negligent, hire an attorney and file suit. If he or she has insurance your attorney will know and if not the homeowner must hire an attorney and defend himself or attempt to settle the suit.

I am very sorry to hear of your painful loss and the monetary aspect makes it all that much worse. Best wishes to you in resolving this situation.
