can someone answer this for me? if an unmarried couple with a baby decide to move in a house by december, could he claim head of houssehold on his tax forms in april?

Smile, it's contagious!

No - he cannot claim the child or his girlfriend.  She would have to file and claim the child & herself as head of household.  He would have to file separately as single.

Head of household has nothing to do with where you live. The child does not have to be your dependent, but does have to be your 'qualifying child".  The IRS has changed the definitions for qualifying child and dependent for the purposes of claiming head of household, the dependency exemptions, and the earned income credit.  Go to www.irs.gov for more information on this topic.  There are worksheets that will lead you through the questions that need to be answered.
