Help

a person owes me $500 and it's been a year now and she refused to pay me back. I loaned her the money out of compassion due to her situation that time. However, our agreement was only verbally since she lives in NY and I live in WA. What actions can I take? Can I sue her?

Hi, ---------------- You put yourself in a tough situation. She can say anything (from toally denying getting the loan, claiming it was a present, to saying you agreed that she'll return it when she can [not limitted in time]). You can sue her but your chances to get your money back are low: Without solid evidences it will come down to your word against her word and under this condition it's hard to believe that you'll will win (and your expenses might be high). I believe that your best chances are to talk to her, try to convince her that you were fair to her and wanted to help and the way she treats you in return is not the way you deserve.... that's not the way to show gratitute and being thankfull.... No offence, please, but take it as a lesson to the future and when you make a contract / agreement always write down the terms and get the parties to sign it down. ------------------- Best regards,

Hi,

   My friend OronD beat me to the question.  I would have said exactly the same thing.  I gave him 2 thumbs up.  He gave you an excellent advice.  The court will ask for the written agreement.  You will be wasting your time.  This person is no longer a friend.

thanks for the reply, I really appreciate it.  I forgot to mention that I have the receipt of the money order I sent her for the money she borrowed.  Would that help? The money was used to bail her husband out of jail.  So if I say that the money she borrowed was to bail her husband out of jail and then the judge will see that I'm telling the truth.  What you think?

Hi, --------------- That is an important point as per itself but I don't think that it is enough and sure can't be a solid / hard proof..... She can always say it's a pure coincident or say that you sent it to her as a present (willing to help her in bad time). It gives you better chances but still I don't think it's enough.
