Help with gas fire place

I have a heat N Glow gas fire place that was in the home since 1995. I recently had an issue with the chimney that I had to remove it up to the roof line. Is it code that I need to bring the chimney back up? I thought since its gas it can be capped and vented out the side. thanks Eric

DV Gas Insert
