Gaining custody of minor child away from family members

my husband and i are wanting to get custody of a 16 yr old relative, mother is deceased, dad has never been in the picture...he's currently in the custody of other relatives. however, the minor child wishes to live with us. we are going to ask them to sign over custody to us, but if they say no, i need to know what to do within the courts to gain custody of this child. i believe the child is old enough to tell the judge where they want to live, and has told us he will stand up and tell the judge he chooses us. HELP!, we really don't know where to start, and have put much thought into this, we are not approaching the subject lightly, but there's a 99% chance that the other family members are going to tell us no way, and no longer allow the child to spend time with us once we approach them, so i need to everythign prepared ahead of time for the next step. thanks!

First thing to do is to get a good attorney.  Your attorney can advise you on the best path to take.  Do not try to do this without an attorney. There are so many little details that can hurt you in a courtroom because you're not an attorney.  The child being willing to state in court that they want to live with you is good, but be sure you get an attorney if you want every possible advantage in the courtroom.

It is a poignant time, I can see.  But this case will require the work of a particularly aggressive, highly pro-active PROFESSIONAL attorney.  Please note that the kid may have been brainwashed to hate anyone but the mother figure in his life, may have been coerced to a "sexual preference" (a lifestyle including same-sex intercourse and wholesale sexual deviancy) and may be such a disciplinary problem that even your state's Youth Guidance Authority could have given up.

It is a rare but refreshing occurrence that a child will have grown up with old-fashioned family values, enduring good morals, and any degree of openness despite the designs of "modern parenting styles" that include some of the most dangerous weaknesses that ever drove teenagers to a life of wanton violence.

 In any case, you may need a really good attorney.

thanks to everyone, we did successfully get custody away from the other family relative he was residing with. it was very emotional, and hurtful towards him, b/c they began name calling, and that is unacceptable. glad to know he's safe today, and away from that psychological abuse, and happy as we speak! looking forward to many happy times ahead.
