Father Stole Sons ID

My husbands dad stole his idenity to set up services at a house. when the services were shut off he did not pay the last bills. now the bills are at a collection agency and the thief refuses to pay for them. since we can prove that we did not live at this address and prove who my husband is, is there way to avoid filing a police report and get this off my husbands credit report?
