Nicole Catsouras was killed in a horrific car accident in October 2006. California highway patrol police released the graphic pictures of the accident over the internet (including one of her decapitated head). Pictures are being emailed to the family under the guise of memorials to their daughter or even real estate opportunities (her father is a realtor). Stalkers are sending the family these pictures with messages that say "Daddy I'm still alive."
These are pictures that should not have been released.
The family is thinking of suing police who released pictures of her death through the internet. Do you think they have a claim?
Bloggers/websites who have been asked to remove the pictures from the webiste have said no. Does the family have any legal right to take action against these people?
Yes... they family 100% has a right to sue. If the police did not get any permission from the family for the release of these pictures, then this is a breach of privacy. Also, because if the complete wrongness if it all, I think that there are other things that they could be sued for. I would definitely talk to a lawyer and see what they say. I've never heard of such a thing. I hope they sue.
I heard again on the news that she died while driving her father's Porche. Emails and blog positngs are writing, "what a waste of a porche" and "not so pretty now." What kind of person can write this kind of stuff? Is this jealousy because she came from a well-to-do family or because she happened to have been a very pretty young girl? What type of individual would do this?

I think they could level a civil suit against the department,but it would probably be settled out of court.The best thing to do would be to order all the pictures removed from the internet (I've seen them.If I was her parent and that was my child it would feel like losing her all over again to know people were looking at her dead body and posting dumbass comments) because the family doesn't have many more legal options.Once a person is deceased,using their likeness is not a crime unless you assume their identity.Furthermore,because her face was unidentifiable,bloggers could say that it's not her on their pages and a defense attorney would argue that very same point for the police department.
