Divorce From Spouse Who Left The Country?

Is there a way to obtain a divorce when my spouse has left the country?  My husband left me several months ago, returned to his homeland (the UK) and I have no idea where he's at.  Neither he nor his family will respond to my attempts at communication.  I just want to get this over with so I can move on.  How do I go about obtaining a divorce from a spouse who literally abandoned me?

I would try talking to a friend or other family member of his, just let them know that you would like him to sign divorce papers.  I would also see a lawyer and see what they suggest.  There is a way to have him contacted by other people other than you.  It can't be too hard to find him in the UK.  Talk to a lawyer and have him/her help you start with the papers.  They will find him.  Good luck.

I think your best bet is to retain a matrimonial attorney, as he/she can help you through the process of filing a divorce with a spouse who has left the country (and he/she can apply to the Court for fees to cover his/her work, as opposed to your paying out of pocket for his/her services). You can locate a great attorney through the American Academy of Matrimonial Lawyers' website. Good luck!

Contact a good divorce attorney in your area of where you have lived 6 months or longer.  Explain that you have been abandoned and want to file for a fault divorce.  There are two types of divorce.  No fault and fault.  No fault, it would be an agreed divorce.  Fault, only one party agrees on the divorce and obviously he can't agree on the divorce because he left you.  You would then file the divorce papers.  Being that he cannot be located, you would simply file it in the newspaper under notifications.  This is solely for this purpose.  This will run for 30 days.  Someone in his family, friends, etc. will contact him regarding the divorce.  If he does not respond to your lawyer within 30 days, you will be awarded the divorce based on default.  So be sure to ask for everything you want in the divorce, be greedy since he walked out.  Goodluck....

I had the same thing happen to me. Husband walked out without notice months ago, returned to his USA homeland, abandoned me and our small children. I too cannot get in touch with any of his family or friends. So I completely sympathise with you. Hoping you get the answers you need :-) Do you have to wait a year after the separation before filing divorce?
